Police: Two Molino Men Arrested For Walmart Theft, One Had A Loaded Gun And Spice

Two Molino men were charged after an alleged shoplifting incident at a Pensacola Walmart during which one was found with a loaded weapon and spice, according to police.

The Pensacola Police Department responded to a retail theft complaint at the Walmart on Creighton Road after Jonathan David Franklin and Dakota Ray Smith, both 25, allegedly approached a self checkout register with a shopping cart full of merchandise and a Stanley roller luggage-type plastic box. After ringing up items worth about $40 with Smith acting as lookout, Franklin pushed the shopping cart into the foyer of the store, according to a Pensacola Police Department report.

They were stopped by Walmart’s loss prevention staff without paying for $578.53 worth of merchandise, the report states. They were escorted to the store’s loss prevention office.

When Pensacola Police arrived and searched Franklin, they reported finding a loaded .25 caliber semi-automatic pistol in his pocket, a snuff can with a substance that tested positive for spice, and what police described as a “metal fake cigarette” with suspected spice residue.  No contraband was found on Smith’s person.

Both men were charged with felony retail theft coordinated with others. Franklin was also charged with possession of a weapon by a convicted felon, possession of a controlled substance without a prescription and possession of drug paraphernalia.

Franklin remained in the Escambia County Jail Monday morning with bond set at $26,000.  Smith was released on a $1,000 bond. Both men provided the same address on Cedartown Road in Molino at the time of their arrests.

    Why would the people at Wal-Mart say he stole the stuff if he didn’t ? Im sure the security cameras show he didn’t have any of those items with him when they came in the store. They are both thieves and should not be treated any different than just that …Besides the article says he had a loaded gun and he is a convicted felon, he committed a crime before he even walked through the door. Jail might even save his life.

    The true story is not this. Yea he had that stuff on him but everything that he was returning was not stolen. I was with him when he bought all that stuff from Wal-Mart. Jonathan Franklin is a good man yea he did his dumb stuff but if anyone had to walk in his shoes for a day No one would last a sceond. He was returning all that stuff so he could take care of his kids. No one has the right to judge. I’m sick of people down grading my brother when noone knows his life. And for saying he is useless wow. Again No one has the right to judge everyone makes mistakes.

    well make a example out of these useless two people . see they got too much time on thier hands find them something to do that they can do well in prison enjoy your new life in prison !!!!!!!!!!

    @Trocarman if being a tattle tale, nosey, wanna be citizen cop hater were a crime you’d be in prison for as long as you’re always screaming for this abstract “judge” to sentence people. Get a life man and stop wishing prison on people you dont know. You follow the golden rule and worry about yourself a little more and others a little less and youll have your hands full.

    What I’m thinking is how would you like to be the loss prevention person who sat in that 5’x10’ room waiting for law enforcement while this guy has a loaded firearm on him, they do not search people when they detain them. If your armed while committing a crime whether your allowed to legally possess or not and it shouldn’t matter if it was used the charge should be enhanced.

    These two are criminals who apparently have not learned how to live in society. The judge should help them by putting them both in prison.
