Convicted Felon Pulls Gun On FHP Trooper

An Escambia County man is accused of pulling out a gun on a state trooper during a traffic stop.

The incident happened early Monday morning on Lillian Highway.

According to the Florida Highway Patrol, 28-year-old Markies Devon Smiley rushed the trooper’s car and reached for a gun.  The trooper used a taser to stop him.

Smiley was charged with resisting arrest,  possession of a firearm by a convicted felon, carrying a concealed weapon and failure to obey police. He was booked into the Escambia County Jail with bond set at $17,500.

    You suggested that some cops just shoot people without justification and even their own cameras show they didn’t have justification sometimes. Well, let me tell you an interesting fact. Those body cameras are wore in fixed positions are the field of view is limited. I wear one every day that I’m on duty. I have forgot to turn my body camera off on more than one occasion after a call and went to tinkle. From the sound, it’s clear what I’m doing, but fortunately, you can’t see my private parts or the toilet.

    Depends on the weakling Judge in this county. Too many get-aways with their crime and not enough put-aways. I agree with most of you – shoot them dead and leave them where they were standing.

    I agree with Bill. Should have shot that smirk right off his face. Now the taxpayers are on the hook to feed this criminal.

    They can. Many do. The problem is that sometimes their own cameras show they weren’t provoked or otherwise justified. This makes folks distrust the officers. This makes life more dangerous for all officers with folks worrying that the policeman stopping them may be about to blow them away. Some think, “I better shoot first,” and an officer just wanting to let them know about a low tire dies.

    ..ARE YOU KIDDING ME ?…$ 17,500 BAIL FOR A CONVICTED FELON WHO WAS ATTEMPTING TO KILL A STATE TROOPER ?…….YES..I KNOW HE DID NOT GET TO HIS GUN..BUT IF HE HAD , HE WOULD HAVE USED IT..THIS STOREY COULD HAVE HAD A TRAGIC ENDING…CONVICTED FELON S WITH FIRE ARM CHARGES SHOULD NEVER BE BONDED OUT..SENTENCING GUIDELINES SHOULD GO AWAY..AND JUDGES SHOULD BE ALLOWED TO DO WHAT WE PAY THEM TO.DO..

    Good job Trooper….you did good. You made the right decision, and make us all proud. Sometimes the perp leaves us with no decision, and we have to live with that for a long time, and, always wonder if there was another option.

    I’m with Bill on this one. I’m sorry all law officers can’t shoot to kill and be done with it.
    Once this idea caught on, the officers wouldn’t be in danger and neither would we. Yeah, I know, we don’t live in that kind of country.

    Should have shot him dead – he is a rabid repeat offender and in a split second he was hell bent on ending the trooper’s life.

    Thanks for reporting this. The national mainstream networks will never report that, while lethal force was fully justified, the trooper was able to subdue the armed felon with non-lethal means. I certainly hope that Mr. Smiley realizes that he just got another chance at life.

    A felon facing years in jail for having a gun shouldn’t be able to bond out period. The only thing standing between public safety and this animal is $1750.00 for bond.

    We waste so much money in the courts and on trying to rehabilitate these people. Just build more prisons and get them off the streets for longer periods of time. The junkies can get “clean” sitting in their cells. Evidently, this guy wasn’t in long enough the first (or second) time.
