Home Invasion Suspect Held At Gunpoint Until Deputies Arrive

An Escambia County, AL, homeowner held a home invasion suspect at gunpoint in his living room until deputies arrived.
The Phill Road homeowner told the Escambia County (AL) Sheriff’s Office that his family was sleeping about 2 a.m. Saturday when they were awakened by the sound of breaking glass and realized that someone was inside their home.
The homeowner retrieved his handgun and went into the living room. As he cocked the weapon, the suspect came up from behind a couch asking the homeowner not to shoot. The homeowner’s wife called 911.
When deputies arrived, they found the suspect being held face down on the floor. The suspect, later identified as 37-year old Robert Ryan Delgadillo, was taken into custody without incident. During their investigation, deputies found an open folding knife believed to belong to Delgadillo.
Delgadillo was booked into the Escambia County (AL) Detention Center in Brewton with bond set $50,000 for a charge of burglary first degree. He is also being held on a violation of probation charge from an unrelated incident.

I’m usually sound asleep about 2 a.m. My .45 ACP mounts a great little flashlight so that I don’t shoot a friend or child. I would shoot an armed intruder usually unless he surrendered immediately and utterly. I awaken quickly but fear that I could shoot before the perpetrator could surrender utterly. Don’t want blood on my carpet or hardwood floors. Still, I’d rather be cleaning up his blood than having my wife mopping up mine. Hollow points and other defense ammo are EXPENSIVE and you are loathe to waste them but when needed, spend a few dollars. Redundancy can be a great thing to avoid being shot yourself; if they’re worth one shot, give until it hurts. DON’T LET THEM HURT YOU!
More damage here than a window! Once someone has broken into your home at 2 am with a knife, will you ever feel as at ease at night in your home again? Not likely! He stole some peace mind from this family. PTSD is also likely for a while, likely be at a high state of readiness for a while. Police are trained to expect a second person.
Homeowner was prepared, protected his family from a lethal threat. Cowboy’d UP!
He’s very lucky to be alive. He came in there to hurt them by having the opened knife. It makes me mad thinking about it.

I believe this man that didn’t kill this thief is very unnerved me I know I would have blown his brains out and ask questions later with no regrets funny how people are different seriously I would have shot him dead see i play with a 44 mag or 12 gauge loaded with mag buck shot to bad this one got away !!!!

As far as my conscience, I’ll sleep like a baby knowing I smoked someone who broke into MY home. I’d shoot him twice for bringing a weapon with him.
As far as the law, I point you to the Castle Doctrine. If they enter your home illegally, you have the right expect that they intend to commit great bodily harm or death and you have the right to use lethal force to defend yourself and your family.

Thanks. It was spelled “Phil” by the Sheriff’s Office. We’ve since verified that it is Phill Road and updated the story.
While I don’t want to live with killing someone, I’ll shoot the legs of anyone who doesn’t belong inside at 2:00am. Those people are pure saints.

I’m fairly certain that if someone surrenders to you at gunpoint and you shoot him anyway, that would make you a criminal too, in the eyes of the law and your conscience. Now, if he thinks he can out fight you with that knife, blast away. But before you start shooting holes thru your couch make sure its not one of your own kids crawled in there drunk.

I don’t think he has the right after he broke into their house to tell the home owner what he thinks he should do with that cocked and loaded gun.

“Don’t shoot” really? I was just going to steal your hard earned belongings and if need be slit your throats while invading the sanctity of your home.
As it should be. The only things injured are a pane of glass, a couple’s good night’s sleep and an offender’s freedom.

Good constraint by the home owner. I probably would’ve shot first and said a prayer for his soul.
If the homeowner would have shot him it would have saved the tax payer a lot of money. Kust sayin. Not saying he should have.

The 2nd Amendment saves lives. If he were just a burglar there was no need for an open knife, he came prepared to do harm.
