Driver Involved In Crash After Swerving To Avoid A Cow

A driver that reportedly swerved to avoid a cow in the road was involved in a two vehicle crash Tuesday night in Molino

At least least one person was transported to a Pensacola hospital by ambulance following the 6:45 p.m. crash on Highway 97  north of Gibson Road. Their injuries were no considered life threatening.

The cow, which remained near the scene following the crash, was not injured. Additional details have not been released as the Florida Highway Patrol continues their investigation into the crash.

    Every owner of livestock who intentionally, willfully, carelessly, or negligently suffers or permits such livestock to run at large upon or stray upon the public roads of this state shall be liable in damages for all injury and property damage sustained by any person by reason thereof.

    The owner of the cow is only responsible if he knowingly knew that there was a hole in the fence for his cows to pass through or if he was negligent in leaving an opening for the cow to pass through. Otherwise, cows and horses, etc., that get out by accident or by an act of God, (tree falls on fence, leaving a passage way open), the owner is not held accountable.

    @Rick – maybe. We’ve found that the local law enforcement folks tend to know who owns livestock and horses in our area :-) . I think it would be better to claim the cow than to lay low and get found out trying to avoid responsibility. I know it will be costly, but it’s the right thing to do. Besides, the cow may be branded or micro-chipped.
