Court Orders Resentencing For ‘Gravely Ill’ Sex Offender

An appeals court Monday ordered a new sentencing hearing for a “gravely ill” Santa Rosa County sex offender who could face nearly five years in prison for failing to report a new address.

The inmate, 50-year old Anthony Paul Childers, sought to have his 57.6-month sentence reduced because of severe medical conditions including cirrhosis of the liver and internal bleeding. His attorneys pointed to part of state law that allows such reductions when inmates have physical disabilities and are “amenable” to treatment.

A Santa Rosa County judge turned down Childers’ request.

But a three-judge panel of the 1st District Court ordered resentencing because it said it was “unable to discern from the record why the trial court rejected (Childers’) request for a downward departure sentence.” The ruling said Childers pleaded no contest to a charge of failing to report or register a change in address. It said a circuit judge should determine whether Childers meets the legal requirements for a reduced sentence and, if so, whether that is the “best sentencing option” for him.

    He’s a habitual criminal. Too many convictions. LIFE SENTANCE ! I can forgive and even embrace someone who makes a mistake. This guy is not offering anything positive for the community. Wake up judges, prosecutors, and citizens.

    To those complaining about his medical bills in prison on the tax payer’s dime, who do you think will pay for his medical bills if he gets out early? It is doubtful he will have a job with medical benefits or insurance because so many jobs refuse to hire anyone convicted of a felony crime. So he will still be on the tax payer’s dime if he gets out because he will either qualify for medicaid or he will be going to emergency rooms for care–like so many who don’t have insurance via job. At least in prison, we can control who he gets to harm while being treated.

    This doesn’t mean RELEASE HIM.
    It means explain why you think you shouldn’t.
    Put it on record.
    If demeanor or nature of his previous crimes and current capabilities indicate he is a real threat, they still don’t have to release him.

    I fail to feel any kind of compassion for this pile of garbage at all. He needs to do his full sentence and I would say he doesn’t deserve to have medical treatment either. It’s not the states fault(or taxpayers) that he drank enough to kill his liver. Sad enough that we have to pay for his meals as it is!!

    We are down on sex offenders and drug abusers and and anyone who sells anyone drugs. I’m always amazed at these low lifes who commit a crime then think they shouldn’t do the time. But what’s more amazing are those low lifes who pity them and think they should get out before they’ve done their time. Why don’t you guys change places with the jailbirds and then you’d feel better……

    This wasn’t the first time he failed to register as an offender and got this prison time. He knew what he was doing when he done his crime in Texas then came here and fails to register. Sickness or no sickness he needs to do his time. Like Local stated his victims are still living in the prison he created for them. Let him die where he lies (in prison). We have paid for worse people in prisons.

    Do y’all know the details of the sex offender’s crime? Sex offender status can be as unfair as two underage teens having consensual sex all the way up to rape. This guy wasn’t labeled as a predator, so maybe he is not a repeat offender.

    Cirrhosis of the liver is usually a death sentence. Do we want to pay all his medical bills while he withers away and dies in prison?

    It seems that people don’t have compassion anymore. That is sad.

    I agree….2 of the Billing’s murder’s were turned down & both died in prison..as should Anthony Childers….50 yrs & w/those illnesses should have to do THE TIME..SEXUAL OFFENDER!!!!

    If this man is so “gravely ill” he may not live to serve out the 57.6 month jail time.
    Having him out of jail is much less costly to the county taxpayers as medical cost for inmates is extremely high.

    Hope those judges remember, when deciding, what he did. Silly me, but if I were in prison and knew for sure I would die in a matter of months. I would be sorely tempted to take several deserving you know whats with me if they let me out. So, why let him out. He knows hes gonna die, soon. He may decide to go get as many kids as possible before he goes.

    Idiot should have registered his address. But I see people all the kill down on sex offenders. But dont see the same about someone who is selling your child drugs. I guess getting your child hook on cocaine is ok.

    His victims are still living in the “prison” he created for them. A lot of convicts die in prison for their crimes, what makes this one any better? And why didn’t he register his new address?

    When voting, remember this when you come to the retain or dismiss the judges. Replace them every time you can.
