Resident Shoots Burglary Supect

December 13, 2013

An Escambia County resident shot a burglar early Friday morning.

Just before 2 a.m., the Escambia County Sheriff’s Office responded to the 700 block of North 46th Avenue in reference to a shots fired disturbance. According to the resident, he discovered someone attempting to break into his garage/storage shed. The resident said he discharged his firearm at the suspect, striking him once. The suspect was later identified as Daniel Joshua Driver, 19.

As deputies responded to the area, they observed the suspect running from the residence. Deputies searched with a K-9 but could not find the suspect. Several hours later, Driver attempted to check himself into a local hospital under a fake name, claiming he was stabbed somewhere off Hollywood Avenue.

The hospital determined they had been provided false information and contacted the Sheriff’s Office. Driver later confessed and was subsequently treated at the hospital, released and arrested. He was charged with burglary and petit theft. His bond was set at $1,250.

I feel sorry for the home owner. I know he may feel bad about shooting someone. I do however thank you Sir for sending the message to thieves/burgulars that if you steal or break in you may be shot.

I feel compelled to ask Mr. Green if he feels no one in this world is entitled to their own opinion? It seems reading comments on North Escambia that not only does he have something “clever” to say about everything, he argues with other individuals who’s opinion isn’t his. Regarding the comment I made about this story I felt the need to put forth that opinion. Apparently some people think if you believe one thing you must believe something else (not true and did not even see the possible connection). I think I’ll just keep my comments and opinions mine rather than have a “know it all” material to work with.

    @Donald Chewy Bean

    Are there legal burglars?

Yes, they’re called democrats. They’ve been stealing from people for years. :-)

    REGARDING:
“The low bond by it’s very nature sends the message that Government sees crimes against individuals as insignificant.”

If so, I guess this is another indictment of the educational system for not teaching students that the purpose of bond is not to punish the accused, but to assure the accused will return to stand trial while allowing freedom until such time — if any — of conviction.

It would be unjust to keep you in jail for years pending trial just because you were accused of something you may not have done (and anybody can accuse anybody). Even so, it is not unheard of for people to not make bond, spend much time in jail only to be acquitted of the charges against them which even if found guilty would have served less time in jail than they did while waiting to be found not guilty.

People who are flight risks need higher bond to assure they will show up for trial. People who are dangers to others or who would skip out on trial rather than face trial should not be given any bond. For ALL OTHERS our Constitution REQUIRES the bond not be unreasonable.

I think Charles point was missed; the bond amount in comparison to other charges is extremely off. I’ll go further and say that crimes against private citizens should be looked at as more serious than say, a crime against “society”, otherwise private citizens will, overtime, become their own 911. The low bond by it’s very nature sends the message that Government sees crimes against individuals as insignificant.

    REGARDING:
“was attempting to enter the victim’s residence.”

If the garage/storage in question is not part of the building in which he resides, that might not cover this situation. (It might be, me not know.) If he turned in a threatening manner while holding potential weapons, however . . ?

Florida State Statute 776 provides for the use of force, including deadly force when the suspect, Daniel Driver, was attempting to enter the victim’s residence.

Remember friends, people with no drivers license are just ” Undocumented Drivers ” like illegal aliens are ” Undocumented Immigrants “.

Too bad the victim only winged the kid. Seems like a waste of a good knockdown round to me but I guess it got its point across. Sdaly enough he’s back on the street and might try to retaliate. Better luck/shot next time.

Hopefully he will learn from this mistake and take it as a second chance. Having seen his FB page, this storm was seen coming a long way off – in other words, he was continuing to follow his actions.

To bad the home owner didn’t get a better shot… It would have saved us, the tax payers a lot of money. Heck that time of morning the homeowner is half asleep and anything would look like a gun, putting him/her in Danger! Case Closed :)

    I agree cygie…

But the law may not cover discharging a weapon at someone outside.

  13. PSU1Earl on December 14th, 2013 7:50 am

IMHO, his bond does need to be higher. For those with suspended licenses its just fine the way it is, because I don’t have much sympathy for them either. They choose to break the law, they pay the price.

I am surprised someone hasn’t been shot before this for breaking into someone’s home/shed/garage/vehicle. People will defend themselves and their property.

  15. Don on December 13th, 2013 7:30 pm

Well more likely than not the homeowner will be charged with a crime..the law say’s you cannot shoot someone for stealing your property unless you felt your life was in danger….illegal discharge of a firearm….

  16. Cantonment on December 13th, 2013 4:42 pm

    At Donald Chewy

Yeah there’s legal burglars their in Washington and have been stealing my money and giving it to lowlifes everywhere since the day I started working!

  17. David Huie Green on December 13th, 2013 3:48 pm

Caught that did you? Good job.

Nope, no legal burglars, just as there no legal unlicensed drivers.

    Are there legal burglars?

  19. Carmen on December 13th, 2013 1:49 pm

Charles, the Escambia County Sheriff’s Dept does not set the bond amounts, the Court System does that.

  20. David Huie Green on December 13th, 2013 1:22 pm

Do you want bond to be cheaper for the illegal drivers or more expensive for the illegal burglars?

    Or more expensive for both?

  21. Charles on December 13th, 2013 12:34 pm

Prime example of how retarded the judicial system is. He gets a 1250.00 bond for breaking in someone garage. And people that gets caught driving on a suspended license gets a 5000.00. Way to go ecsd

  22. cygie on December 13th, 2013 12:23 pm

Yep. Lead poisoning will certainly put a stop to breaking and entering.
