Third Suspect Charged In 2012 Lottery Store Murder

A third suspect has been charged with murder in connection with the November 2012 shooting death of a Davisville lottery store owner.

Michael Brad Orso, age 28 of Atmore, is being held in the Escambia County Jail without bond on one count of  premeditated first degree murder. He was indicted last week by an Escambia County Grand Jury and arrested in Alabama. He waived extradition from Alabama and was transferred to Florida late Friday afternoon.

“Orso was looked at from the beginning as a possible suspect,” Assistant State Attorney Greg Marcille told NorthEscambia.com. “There was additional information presented to the grand jury last week.”

Marcille said the State Attorney’s Office will not release any further information at this time about Orso’s alleged involvement in the murder.

Two other men — Malcolm McGhee Jr. and Brent Lambeth — were  charged in connection with the shooting death of 74-year old Thomas “Tommy” Kroll during a robbery on November 6, 2012, at the State Line O’ Yes Lotto on Highway 97 in Davisville.

Lambeth, 21, has pleaded no contest to second degree murder. Under his plea deal, he will receive no more than 30 years in prison, provided he testifies against his co-defendant and alleged triggerman,  25-year old Malcolm McGhee Jr.

Jury selection is set to begin today in the trial of Malcolm McGhee Jr. on charges of premeditated first degree murder and robbery with a firearm.

Marcille said he does not believe the arrest of Orso just days before the start of McGhee’s trial will have any impact on his case.

The Robbery, Murder

Previously released documents detail the events that unfolded last year inside the iconic pink lottery store at the Florida/Alabama state line. None of those documents mention Orso or allude to the presence of Orso or any other unnamed male during the robbery and shooting.

When Escambia County Sheriff’s deputies arrived at the lottery store on the afternoon of November 6, 2012,  they found store owner Thomas Gerald Kroll had been shot and killed. Witnesses at the store told deputies that two suspects wearing ski masks had entered the store, armed with a handgun. Witnesses said they  asked “Where’s the man with the money?” before firing two shots and killing Kroll.

Kroll fired at least one shot at the suspects.  Authorities have not revealed if Kroll or one of the suspects fired first. One shot struck McGhee. Prosecutors said he was wearing a large cross pendant around his neck that may have saved his life. The bullet struck the cross and did not injure him.”  McGhee’s wound was non-penetrating.

The two suspects had fled the scene of the crime before the first law enforcement officers arrived on the scene.

According to official documents, Kristen McGhee told investigators on the day of the murder that she was with Malcolm McGhee and Lambeth when they drove to the O ‘Yes Lotto store for the purpose of purchasing Spice. Lambeth, who was driving, backed their vehicle into a parking space in front of the business. Malcolm McGhee and Lambeth got out of the vehicle, leaving the car doors open and leaving Kristen McGhee inside the vehicle.

Kristen McGhee told investigators that moments later she head four gunshots.  Lambeth then ran back to the car,wearing a ski mask over his face, and told Kristen McGhee that Malcolm McGhee had been shot.

Macolm McGhee then got back in the car, official reports state, with a ski mask over his face. He was also armed with a handgun. Malcolm McGhee then “told her he had been shot and he shot the guy that runs the store”, according to an Escambia County Sheriff’s Office report. Kristen McGhree told deputies that both men stated  they took Spice from the store during the robbery.

According to official reports, another female, Mallory Young, told investigators that she was with Malcolm McGhee on the date of the robbery when “he asked if she could keep a secret”. He then told her that he had been shot earlier in the day, and he shot the guy that operates the lottery business.

McGhee and Young have not been charged with any crime in connection with the incident.

    I know tommy was a really great person he will be missed. for all involved I feel sorry that they wasted there life for such drugs. only our GOD knows what happen and they will be judged bye him. the truth will set you free!!! rest in peace tommy.

    I am his aunt there is no way my nephew would have ever done such a horrible crime that boy was well. Manner an would not even hurt no ones feeling much less this crime baby this is your aunt sharon I love you an will pray that GOD WILL BRING YOU HOME i will fined out where u are an we even Dana will be there all the way baby auntie want forget you for real your cuz said hold your head up we will see u soon we love you baby pray an pray the truth will come to light we praying for you u son I’m so sorry for the family that is involved I also will pray for peace for there family also I love you baby keep praying that the truth will set u free………..

    And yet it is our civic amd Christian duty to serve on juries if called and to faithfully render a judgment. Further, it is our duty to our families and neighbors to warn them of dangers, including criminals — known or reasonably suspected. We don’t judge the destination of his soul but we might judge legal guilt or innocence. Those who judge us wrong for doing so ate violating their own rules

    I truely believe Orso took no parts in this and if I’m wrong god forgive me. But it looks like the young man who just took the 30 years did all he could to reduce wat was comin to him. Orso u are in many prayers u have so much support. May god bless you and see u through this. Oh yea maybe he hung around atmore because he had nothing to do with this. Y should an innocent man run??? There’s no reason.

    @ Melodies4us–Looks as if Lambert cut his own deal. He is to testify that McGee was the shooter. Does not look as if McGee set Lambert up to take the fall based on the story as report here. McGee is looking at life, Lambert 30 years max for testifying. Not a great deal, but could be worse for killing the store owner. Question for those who keep saying that Orso would not be involved in this– you say he’s done “other things” but he wouldn’t be involved in this. Ask yourself–what has he done–and would you want to be his victim in the “other things he’s done”?

    They have probably had these 2 ( McGhee & Lambeth ) isolated, and probably are offering McGee a “deal” because he is talking and therefore Lambeth will wind up taking the rapp. McGhee told 2 witnesses that he shot the store clerk. This is our injustice system. . . Offering 1 inmate a plea bargain to get information about the crime. Obviously, McGhee is talking and Lambeth isn’ t , making it easy for McGhee to”pin” Lambeth. I hope justice is served and this jury has enough good sense to see through all these shananigans.

    Brad grew up close by me i and i know him well. i don’t see him involved in this he was always too smart. he may be guilty of some other things but i really dont think he would do or be involved in this. i sincerely hope not he was al;ways a pretty decent kid compared to lots of others. i hope everything pans out for him if he wasnt involved but if he was god help his soul. this was an awful cime and those involved should be punished

    I don’t believe this story. Brad is not that kind of person. What happened to the elderly man is terrible and heartbreaking but I don’t see Brad being involved in this. Everyone on this internet will only judge and hide behind the computer screen to make comments but you don’t know this man and “Let him who is without sin cast the first stone.” Brad, I’ll be thinking and praying for you.

    Maybe young Mister Lambert was offered a deal. He would have to give the names of all of player in the crime and tell the full truth in court.

    Over a year this joker hung around Atmore. He could have walked to Mexico in a year.

    He was not too smart to begin with in the first place, getting mixed up in such a hair brain scheme with Lambeth and McGhee.
