Bratt Child Molester’s Sentence Cut From Life To 25 Years

A 73-year old Bratt child molester’s life sentence was reduced to 25 years  by an Escambia County judge Friday afternoon.

Jody Posey was re-sentenced by Judge Michael Allen to 25 years state prison followed by lifetime community control, and he was designated as a sexual predator.

Posey received the life sentence in early 2010 from Escambia County Circuit Court Judge Kenneth Williams after being convicted by an Escambia County jury on charges of lewd or lascivious molestation of a child under 12.

The Florida First District Court of Appeals found that the life sentence handed down by Judge Williams was improper and sent the case back to Escambia County Circuit Court for re-sentencing before a different judge. In quashing the life sentence, the District Court of Appeals found it violated the precedent set forth by another case in which the judge erred by appearing to punish the defendant for failure to show remorse for a crime in which he denied involvement.

Posey’s conviction was affirmed by the appeals court.

He was arrested March 5, 2009, for fondling a five-year old girl at his residence at 7100 North Pine Road in Bratt between November 2007 and January 2009.

The child victim took the witness stand and testified about Posey touching her underneath her clothes as she sat on his lap. The most recent molestation reported by the five-year old was January 9, 2009. The girl told officials that Posey said she would go to jail if she told anyone about the incidents.

Posey was also convicted of molesting another girl at his home between 2001 and 2006. He was sentenced to five years in state prison on those charges. His appeal on that conviction was dismissed by the appellate court.

    I can’t stand to look at his face. If he doesn’t repent in prison, his sentence will last for all of eternity.

    this is for all the parents and grandparents out there… it does no good to try and shield them from pretators like this.What really works but is sometimes uncomfortable to talk about is educating the children about how to protect themselves.I did a program one time for Escambia County Homemakes on teaching people how to educate and thus protect their children from pedophiles,being lured into a car.It was an outstanding program,not becasue I taught it but because the material covered was outstanding.Common things a child could use to protest themselves.Parents EDUCATE your children no matter how young.That is the key to providing them the tools to take care of themselves in potentially harmful situations.

Do you know that when you get to the end of the road and their are no detours, you better have all the right answers? Hang in there I hope you live to be a 150, then it will give you a chance to think about what you did for a long time.

    In this day and time it seems the judicial system looks at this as “Oh, it was just a child molestation case” and they let these disgusting pieces of trash out, or out early anyway. And our children and world are the ones who suffer for it! What is wrong with people! These are our children we are talking about here!
    Obviously the best thing to do as a parent. is TAKE CARE OF IT YOURSELF! The courts sure aren’t going to do it, so be prepared Mr. Judge when parents start giving the justice that our kids deserve. You can bet I’m prepared to do it!

    Terri—No I’m not mixed up on the judge. Look back and I think you’ll find Williams gave this jerk “life” because he did not show remorse. I read it as Williams let his personal feeling enter into this. This has happen before with Williams and he has had cases returned to his court and to other courts. When he first made judge he messed up so many cases he had to be sent to kiddie court for a while.

    Great Great Great!!! A waste of tax dollars to cut his time down to 25 years but I think Justice was served!!! He will not see the sunshine from the other side of the fence… Last time I checked you had to serve 85% of a sentence in the state of Florida!!! So instead of being mad ppl do the math this man is 73 yrs old has to do atleast 21.5 years thats means he will be about 95 give or take a few months!!!!! He will prob die from worrying in a couple of months!!! Not saying that to mean but it is going to be alot of Big jerry’s waiting on him!!! But more than likely he will be in closed cust!!! Either way 21.5 years is along time!!! He is 73!!!!!

    Molino Jim… don’t you have your judges mixed up here? Williams gave him life…Allen gave him 25 years which means he will be out in less than 10?

    I would imagine that General Population, at a place like Rayford Correctional, would give Mr Posey, a new perspective on life, and molestation.

    The 25 years should take care of this problem. Try to remember “judge” Williams when you are ask if he should “be retained as a judge” on election day. I have known Williams for about 30 plus years, while he is a nice person he’s not much of a judge. Williams was put on the bench as a token when it was the “right thing to do”. While at the State Attorneys office he was a joke as an attorney. His track record is poor and the number of cases sent back to his court or to other judges court is high. Maybe it’s time to let him opon his own law office and stop feeding at the public trough.

    25 yrs for a thug? This (judge?) has lost his mind. HE should get 25 yrs for inpersonating a judge. Is he on the T _ _ _? He sounds just like that former melie mouth Massachusetts governer Dukakcus who was running for president and was ask would he want the death penalty if his wife and daughter was RRM?
    Didn’t this Bratt Childe Molester know what he was doing in 2001 2006 2007 an lord knows other years. He should never see the light of the day for as long as he lives.

    At 73 what is the difference in a “life sentence” and one that is 25 years? Judges against judges and their little personallity quirks seemly waist a lot of taxpayer money.

    Now changing that was ridiculous….the man is 73 – probably done 1 year so far – so he’ll get out when he’s 97…….hopefully that is life for him……I know, I know, he can be eligble for parole in so many years now – that judge should be horse whipped!!! He could have at least said without parole!
