Former Ala. Cop Busted For On-Duty Pharmacy Burglary With His Brother

A former Alabama cop has been arrested for allegedly helping his brother burglarize a pharmacy while he was on duty. The brother was arrested earlier this year at a Pensacola motel.

Matthew Kirk, 36, of Brewton was arrested Tuesday after being indicted by an Escambia County (Ala.) Grand Jury. The former East Brewton Police Department lieutenant (pictured left) is charged with two counts of third degree burglary, one count of second degree theft of property and one ethics violation.

Authorities believe Kirk aided his brother in the burglary of a Fred’s pharmacy in East Brewton on March 23. Kirk was the only police officer on duty in the small Alabama town at the time the burglary occurred.

The police officer’s brother, Jason Daniel Kirk, 30, of Flomaton, was arrested in April in Escambia County, Fla., with just under a half pound of illegal pills.

Members of the Escambia County (Fla.) Sheriff’s Office Narcotics Unit executed a search warrant at Kirk’s room at the Value Place Extended Stay hotel on Scenic Highway in Pensacola. During the search of the room, deputies found a lock box that contained quantities of Xanax, oxycodone, methadone, morphine and hydrocodone, according to the arrest report. One bag of hydrocodone weighed in excess of 200 grams (0.44 pounds), the report stated.

kirkjason.jpgThe room also contained sales and inventory figures for the illicit narcotics, and the key to the safe was located on Kirk’s person, deputies said. Kirk (pictured left) admitted to ownership of the narcotics, according to the Sheriff’s Office report.

Investigators said at the time that they believed the pills were from the East Brewton pharmacy burglary. Jason Kirk later told authorities that his brother Matthew Kirk was his accomplice.

Matthew Kirk resigned from the East Brewton Police Department in April. He was booked into the Escambia County (Ala.) Detention Center on $100,000 bond.

Jason Kirk remains in the Escambia County (Fla) Jail on $307,500 bond. He has entered a not guilty plea on all charges and is set for trial in September. At the time of his arrest, Jason Kirk was also charged with negotiating a $57.45 worthless check at the Southern Pit Stop, Inc. in Century. He pleaded guilty to writing the bad check and was sentenced to 60 days in jail.

    Hey good ole boy…how bout you do some research…jason was arrested on April 9th and matt resigned on April 15th…which if you can add you can see that it wasnt the day after and you can make all the asumptions in the world but until you ask Matt yourself dont think you know his motive in his resignation.

    There have been three Grand Jury sessions held between Jason’s arrest and Matt’s indictment, which indicates that police didn’t jump the gun on Matt’s arrest. Being that there was a four month gap in the arrest of Jason and the indictment of Matt I would assume that police were working on the case and gathering more information. I would also assume that a grand jury would have to have more “probable cause” than a junkies word to return a true bill on someone. I am sure that the police wouldn’t give out all the details from their investigation in a press release. I believe that I will give the police the benefit of the doubt. I will assume that they investigated the case, put all of the evidence together and made the arrest based on that evidence.
    PS: Oh and something that may blow your “good ole boy” conspiracy theories out of the water. Don’t forget that Matt resigned the day after his brother’s arrest and that the FBI was called in to assist in the investigation.

    You answered a lot of questions and it’s almost what I figured.
    I believe you and god help you.

    The whole thing just smelled fishy to me and I’m still a pretty
    sharp old broad. lol

    If your cop brother is as good as you say I hope he can redeem
    himself and get his job back. I hope he wants it back.
    We need ALL THE GOOD COPS WE CAN GET.

    I’m sure this will all come clean in the wash.
    At lease I hope it will
    I have to admit I am rapidly loosing faith in our justice system.

    Jason Kirk has been medically deemed a Sociopath if you are not familiar with what this is I ask that u google it. I am not posting to argue I’m posting to support my INNOCENT brother Matt Kirk. Our family has had problems with Jason since he was 8 yrs of age in and out of jail in and out of rehabs in and out of homes and has always had mental problems. Matt honored the badge he wore and stood behind his values and was always there and still will be for anyone and everyone who needs him. Being a Police Officer is something Matt is so proud of and still is even when everyone has turned their back of him. Matt is a wonderful person, a loving caring husband and father and the best brother! People are so quick to judge someone by something written in the papers and point fingers. All I’m asking is two know both sides and please pray for our family during this long struggle we are about to go through! For the ones supporting Matt I can’t thank you enough, you don’t know how much your support means to us! I said I wasn’t going to post but I am standing behind my family and my brother. Everyone is entitled to an opinion and we are not bitter not for one second. Just please pray!

    I’ve seen many a crooked cop. I’ve also seen a lot that I respected.

    Somehow this just doesn’t sound right.
    I hope they got something more on the Cop than the word of a junkie brother
    who probably has been the bain of his life ALL HIS LIFE.

    The same brother who does drugs when he is older and thinks the only
    way to make money is the easy way, is probably the same spoiled brat
    little brother a lot of us have seen with neighbors kids or somewhere
    maybe even your own family.

    Maybe this brother resents his brother because he is a good guy instead
    of a problem for society. After all the COP sure does make his DRUG
    ADDICT brother look REAL BAD.

    I hope in this case there is only one loser for this family.
    If their both bad it’s going to be reaaaaal hard to swallow.

    I knew both these men when they were just boys. I knew their parents well and they are both fine people. It breaks my heart to see this happen to this family. Not only is one son an addict – he has ruined his brother’s life with his accusations. Can you imagine what this has done to his family? My thoughts and prayers are with all of you. May the truth be revealed and may God’s will be done in all your lives.

    He should be given beneifit of doubt the cops around here r crooked I had one stop me for nothing the other day and had steel on my truck I,m a welder he swore it was copper he searched everythingwhich is fine I dont do drugs but when he didnt find anything it made him mad and he started bout the steel again I have one thing to say bout that there was a piece of sheet metal half inch thick angle iron etc weight all together bout 200 lbs so to all u cops who dont no the difference between steel and copper Please Open A Junkyard cause I would love to sell u alot ofsteel for copper price I would never have to work again courtesy of cops who dont no there metels!!! But r trying to earn brownie points it,s got to be hard to breath with your lips connected to yur bosses butt! Crooked Cops Tricks R For Kids!!!!!

    I hope, no matter what, that they get a fair trial. Brewton court system is not known as being the most honest. That is the only place in America where the law only applies to certain people. Sounds to me like a railroad job. They have his brother cold on a dope charge. Why don’t they INVESTIGATE???? That’s why I say the court system is not exactly straight. Matt Kirk was INDICTED by a GRAND JURY with only the word of his junked out brother?!?!?!? How does that happen? Either way, I hope everything is fair and proper and goes the way of justice. Real justice, not Brewton justice.

    its not bad economy sandra, there’s plenty of drugs at all the local bars. If I did drugs of any kind there’s plenty of it to be had at high prices. You would be surprised at who has them to sell and the people that buys them.

    I had a long story written and the weather messed it up. People don’t chose to b addicts. i DON’T BELIEVE IN STEALING OR HURTING ANYONE , BUT MOST OF THE TIME WE HURT THE ONES WE LOVE THE MOST.     Does it not seem funny that the “Cop” Brother resigned in April after eveything happen. He may have been a good cop, but laws/and rules apply to everyone and guilt may have got the best of him. I feel for their family…

    thank you motherofthree..you are exactly right. Everyone that knows Matt Kirk knows he was a good cop, he would never aid his peice of crap brother. Sounds like Jason would do just about anything to get his time cut to me.

    I sure hope that they have more evidence on Matt Kirk then the testimony of a junkie brother and the fact that he was the only cop on duty. I haven’t heard anything about any video footage or wittnesses coming foward. To his family be strong and hire a good lawyer. Because we all know that Esc. AL makes their own laws and the drug task force is allowed to do what ever they want.
