Felon Busted After Firing Shotgun In Front Yard

A convicted felon  is behind bars after allegedly firing a shotgun in the front yard of his Cottage Hill home.

phelonderric.jpgDerrick Jerome Phelon, 38, is charged with improperly exhibiting a firearm and possession of a weapon by a convicted felon following the incident shortly before midnight Wednesday.

Phelon was “extremely intoxicated and had a strong odor of alcohol emanating from his person” when deputies responded to a shots fired call on Williams Ditch Road. According to the arrest report, the incident started as an argument between Phelon and his fiancee that eventually led to him firing the shot into the air outside their home.  The fiancee and her six-year old son had fled the residence before deputies arrived. They were later located unharmed by other deputies on Highway 95A near Quintette Road.

This was the second time in less than a year that Phelon was charged with possession of a firearm by a convicted felon, according to the arrest report.

He is also facing a bad check charge. Phelon is being held in the Escambia County Jail on $21,000 bond on all three charges.

    REGARDING:
    “And don’t tell me the shotgun fires pellets, I know the difference and a pellet can kill someone as well in this way. Shotgun is actually worse here as there are more projectiles falling to Earth. ”

    Others already pointed out that pellets quickly loose power and are very unlikely to hurt anyone if fired high. Wind resistance sucks up energy. Our neighbors used to shoot doves in the field beside our house. Pellets were constantly raining down on the roof, never even left a dent. Low trajectory would be different.

    The real danger, of course, is a drunk and convicted felon–or phelon–with a gun has already shown bad judgement even before pulling the trigger.

    This man needs to be accountable for his actions, and the ETOH does not excuse that.

    However, firing a shot gun in the air is harmless. The pellets fall to the ground areVERY unlikely to do any harm.

    If he were firing slugs that might be different, but still unlikely to cause harm.

    Luckily thats all he shot. Thank God he didn’t hurt anybody. Maybe we should let him stay at the jail for a while

    I do not understand why some people think swift justice and lock this man up, kill a kid, ask questions later, etc, want the max jail time yet in the case of the DONKEY KILLER, he did shoot something other than air and you wanted cried that it was way too hard of a punishment…..white punk not on drugs even said he/she does not like animals and felt it was stupid for this killer to serve 11 months in jail. HE wanted to kill the kid in the cantonment area who knocked the deputy down, now he is telling me that bullets come back down…and kill people..hello folks. Everyone that breaks the laws deserves just punishment!!!!

    Sounds like a mandatory alcohol rehab program might help this gentleman discover his sober side.

    Shotguns and alcohol are a bad combination around kids.

    The 2nd TIME??? in less than a year? Then what the heck was he doing OUT of jail?
    and the saddest part is a 6 year old child, innocent, defensless, with a Mother who puts him in this situation.
    I say if Mommy dearest goes back to this thug, take this child away from her!!!

    People who fire guns into the air will often kill innocent bystanders. Those bullets have to come back to Earth, and too many times they come right down through someone else’s head. A little 5 year old child who was in Church with his family was killed this way recently.

    And don’t tell me the shotgun fires pellets, I know the difference and a pellet can kill someone as well in this way. Shotgun is actually worse here as there are more projectiles falling to Earth. I think a more serious charge needs to be adopted in these instances. Drunken fool.

    Oh the price of bad behaviour,alcohol guns and the lack of good judgment. How many felonsa have guns? This is like how many people drive with no drivers licence. The answer is, most of them.
    But down in the jail house, you will have AC, heat, TV, meals etc. Oh yes, plenty others to talk to. Have fun.
